The Bill proposes to exempt electronic cigarettes transported through Hong Kong via sea-air and land-air intermodal under a new part of the Import and Export Ordinance. Currently, the smoking regulations already provide exemptions for alternative smoking products that are transit articles or air transhipment cargo. The Hong Kong Special Administrative Region Government stated that it will establish a new regulatory system that will be managed, supervised and enforced by the Hong Kong Customs to strengthen the supervision of intermodal transportation of e-cigarettes, thereby reducing the risk of alternative smoking products entering the local market during intermodal transportation in Hong Kong . The Macau Legislative Assembly today approved the first draft of a bill that will, if passed, ban sales of all vaping products in the wealthy Chinese semi-autonomous region. The proposed law would prohibit manufacture, distribution, sale, import, export, and transport in and out of Macau.The Macau Executive Council announced in January that it planned to propose a sales ban this year. On May 27, the government presented its draft bill, which includes proposed fines of 4,000 Macanese pataca (MOP) (about $500 U.S.) for individual offenders, and fines from 20,000-200,000 MOP ($2,500-25,000) for businesses.The draft bill does not (yet) prohibit personal use or possession, but the ban on import and transport from China would make acquiring products impossible without breaking the law.

A bill passed this week in New Jersey will require vape shops and most tobacco retailers to keep nicotine gum or other nicotine replacement therapy (NRT) products in stock and available for sale. The bill exempts cigar shops from the requirement.If the bill becomes law it will require “any entity that sells, offers for sale, or distributes for commercial purpose any tobacco product to maintain a stock of, and offer for retail sale, at least one type of nicotine replacement therapy drug, device, or combination product that has been approved by the federal Food and Drug Administration for cessation of tobacco use.”

A European Commission public consultation on the legislative framework for tobacco products is underway and will accept responses until May 16. The consultation—the second part of a process that began in 2022—launched in late February. While the consultation seeks comments on all tobacco products, it is clearly aimed at introducing harsher regulation for e-cigarettes and other low-risk nicotine products. Comments solicited will be used to shape changes to the Tobacco Products Directive (TPD) and possibly the Tobacco Advertising Directive. But it is the only tool European vapers and other nicotine product users have available to prevent the adoption of prohibitionist vaping laws.
