The FDA has authorized marketing of two vaping devices and tobacco-flavored refills made by Logic Technology Development LLC, the vape product arm of Japan Tobacco International (JTI). The Philippines Senate today passed a bill that would legalize and regulate vaping and heated tobacco products, and eliminate the Philippines FDA’s authority over the products. The Vaporized Nicotine Products Regulation Act (SB 2239) was approved by a vote of 19-2, with two senators abstaining.The Philippines House of Representatives overwhelmingly passed a similar bill in May. The two bills will now go to a conference committee where they will be reconciled, and both houses will vote on the final version. Then the unified bill will go to President Rodrigo Duterte to sign into law or veto (if he takes no action, the bill automatically becomes law after 30 days).

The Los Angeles City Council on Wednesday passed an ordinance to ban the sale of the candy-flavored nicotine across the city.Officials said L.A. is now the most populous city in the nation to take flavored nicotine products, including menthol cigarettes, off store shelves.The council passed the motion with a 12-0 vote, garnering praise from health nonprofits like the American Heart Association and the American Lung Association.

The Bill proposes to exempt electronic cigarettes transported through Hong Kong via sea-air and land-air intermodal under a new part of the Import and Export Ordinance. Currently, the smoking regulations already provide exemptions for alternative smoking products that are transit articles or air transhipment cargo. The Hong Kong Special Administrative Region Government stated that it will establish a new regulatory system that will be managed, supervised and enforced by the Hong Kong Customs to strengthen the supervision of intermodal transportation of e-cigarettes, thereby reducing the risk of alternative smoking products entering the local market during intermodal transportation in Hong Kong . The bill will be introduced to the Legislative Council for consideration on March 29.

The European Commission plans to impose a minimum excise tax on vaping products for all European Union member states. The new tax would be part of the revised Tobacco Excise Directive (TED), which could also include a doubling of the minimum tax on cigarettes and the first tax on heated tobacco products.

The Free Market Foundation has raised concerns about the government’s plans to regulate e-cigarette and vaping products, which it says could push more people towards traditional cigarettes and the illicit market.The regulations will primarily be introduced through the draft Control of Tobacco Products and Electronic Delivery Systems Bill and new taxes, the think tank said.“The South African government argues that e-cigarette and vaping products are harmful and warrant regulation. However, e-cigarettes and vaping innovations are tobacco harm-reduction products, aimed at mitigating the adverse health impacts associated with combustible tobacco products,” it said.It warned that heavy regulation will lead to exorbitant costs, and consequently disincentivises the uptake of alternatives, leading to the opposite of the intended effect.
